Terms of sales
1. Scope
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between FSR, owner of the website www.tometgaby.com, whose registered office is located at Rue du Bas-beurre 18, 7711 Mouscron, Belgium, registered under the number 0537.163.630, and any person making a purchase on the website www.tometgaby.com(hereinafter referred to as “the Customer”).
The products offered for sale are described and presented as accurately as possible. However, minor variations may occur. The photos are for illustrative purposes only and are not contractually binding.
Prices are listed in euros (€), including all taxes (VAT included). Shipping costs are specified before order confirmation. FSR reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order placement.
2. Orders
The Customer places an order via www.tometgaby.com. Any order is considered final after payment has been received. FSR reserves the right to cancel or refuse an order in case of dispute with the Customer.
3. Payment Methods
Payment can be made using the following methods:
• Credit card (Visa, MasterCard, etc.)
• Apple Pay
• PayPal
All transactions are secure, and no banking data is stored on the website. In case of payment refusal, the order will be canceled.
4. Warranty & Claims
Products benefit from the legal warranty of conformity and the warranty against hidden defects.
Any claim must be sent to hello@tometgaby.com with proof of purchase and, if applicable, photos of the defective product within 48 hours of receiving the product.
5. Liability
FSR shall not be held liable for damages resulting from misuse of the products or force majeure events.
6. Data Protection
The Customer’s personal data is collected solely for order processing and will not be shared with third parties without consent. See our Privacy Policy for more details.
Shipping Policy
1. Delivery Methods
We offer the following delivery methods for shipping your orders:
✅ Mondial Relay and/or Chrono Shop2Shop (Pickup Point) – Free 🚚
✅ Home Delivery (Other Carrier) – fees depending on the destination country
The Customer can select the preferred delivery method during checkout.
2. Processing & Shipping Times
📦 Order Processing: Orders are prepared within 2 business days after payment confirmation.
🚚 Estimated Delivery Times:
• Mondial Relay (Pickup Point): 3-6 business days
• Home Delivery: 3-6 business days
Delivery times may vary depending on peak periods or exceptional conditions (strikes, weather conditions, etc.).
Return & Refund Policy
1. Right of Withdrawal (Online Purchases)
In accordance with Belgian consumer protection laws and EU Directive 2011/83/EU, the Customer has 14 calendar days from the receipt of the order to exercise the right of withdrawal, without the need to provide a reason or pay penalties.
2. Conditions for Exercising the Right of Withdrawal
✅ The product must be returned in its original condition:
• All tags must remain intact.
• The orange security thread must not be cut.
• The pouch must contain the 3 emotion patches delivered with the product.
• Items must be returned in the Tom et Gaby backpack provided.
✅ Some items are not eligible for return:
🚫 Exceptions to the Right of Withdrawal (in accordance with Article VI.53 of the Belgian Economic Code):
• Patch sets if purchased separately
• Gift cards
📩 To exercise the right of withdrawal, the Customer must notify the decision in writing to hello@tometgaby.com.
After submitting the withdrawal request, the Customer has 14 additional days to return the item.
3. Return Procedure
1️⃣ Contact us by email at hello@tometgaby.com, providing:
• Order number
• Item(s) concerned
• Reason for return (optional)
2️⃣ Wait for our confirmation before proceeding with the return.
3️⃣ Carefully pack the items and ship them to the address specified in the confirmation email.
4️⃣ Keep proof of shipment until the return is processed.
📦 A €2 handling fee will be deducted from the refund to cover part of the return processing costs.

4. Refunds
Once the returned item is received and inspected, if it meets the conditions, the refund will be issued via the original payment method within 14 days of receiving the return.
• Initial shipping costs are non-refundable, except in the case of an error on our part.
5. Product Exchange
If the Customer wishes to receive a different item, size, or color, they must return the original product following this policy and place a new order on our website.
6. Order Issues (Defective Item or Shipping Error)
If the Customer receives a damaged or incorrect item, they must contact us immediately, or within 48 hours, with:
📷 A photo of the received product
📜 The order number
Return costs will be covered by us in case of a defective or damaged item.
TOM ET GABY shall not be held liable for damages resulting from improper use of the products.

Intellectual Property
📌 All elements of the website (texts, images, logos, design, etc.) are protected by intellectual property rights and are the exclusive property of TOM ET GABY.
Any reproduction, modification, or use without written authorization is strictly prohibited.
Applicable Law & Disputes
📍 Applicable Law: These GTCS are governed by Belgian law.
⚖ Disputes: In case of disagreement, we encourage an amicable resolution. Otherwise, the courts of Tournai shall have exclusive jurisdiction.
By confirming an order, the Customer unreservedly accepts these GTCS.
FSR reserves the right to modify these GTCS at any time. The updates will be published on the website and will take effect immediately.
